Recently, KJ was arrested back in August. He was formally indicted by a grand jury in early September in Fulton County, Georgia. He faces seven felony counts, which include aggravated child molestation and aggravated sexual battery.
As noted by TMZ, KJ has since faced claims from prosecutors in court. This has included accusations that videos on his phone showed him having sex with an underage family member. This is believed to be separate from the more recent case, which centers on an incident that took place at a gym back in April.
Recently, lawyer Jason B. Sheffield, who is representing KJ, spoke with the outlet, claiming, “The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.” Sheffield continued, “The matter arose from inappropriate, crude behavior involving two middle-schoolers.”
The Previous Case Was Handled In Juvenile Court, Which Kept It From Being Reported On
As the outlet noted, prosecutors told the judge that videos showed penetrative sex and featured KJ using “predatory, derogatory” language toward the underage relative. It was claimed that he was charged with sexual battery of a victim under the age of 16. The case was also said to have been handled in juvenile court, which may have kept it from being publicly known or reported on. It was further alleged that KJ has been under court supervision over the charge since October 2025.
Sheffield claimed that the previous case “did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense.” He added, “Any suggestion otherwise is inaccurate. And creates a materially misleading impression of how the juvenile matter was ultimately resolved.”
The attorney made similar claims during a recent bond hearing. He admitted that he had not seen the evidence from the previous case. However, he claimed that, as he understands it, the video shows “more ridiculous, raunchy behavior,” which is allegedly “boundary-crossing inappropriate” but the cause has ended in group counseling and reunification.
